Terms and Procedure for Limited Time Conditional Refund

Refunds and exchanges are accepted for purchases made directly from PowerBalance.com or at an Authorized Power Balance Dealer within the United States.

Refunds must be submitted via US mail or other forms of nationally recognized delivery service to the following address:

Each refund must include the following and comply with terms and conditions noted below:

• Each Power Balance product for which a refund is sought
• An original proof of purchase for each such product

Conditional Terms for Refund:

1. Any creditor of Power Balance, LLC, debtor and debtor in possession (the "Debtor"), who believes he or she was misled by the Debtor and/or was dissatisfied with the purchase of their Power Balance product, may receive a refund conditioned on the following: (x) such Power Balance product must have been purchased by the customer between January 1, 2006 and December 31, 2011 from any retailer in the United States authorized by the Debtor to sell Power Balance products. The claims period is effective from January 10, 2012 to May 10, 2012 (the "Claims Period") and all claims must be received by the end of the Claims Period to be eligible for a refund.
2. Each creditor may return and request a refund for a maximum of ten (10) units of Power Balance product.
3. All claims must be received by Power Balance Technologies, Inc. (d/b/a Power Balance) ("Power Balance") no later than the final day of the Claims Period.
4. Refund payments and shipping costs ($5.00 per claim) will be capped at $500,000 in the aggregate, and individual claims shall be paid in the order received and opened by Power Balance.
5. Power Balance shall administer all claims and track all refunds and rejected claims.
6. Power Balance shall confirm the authenticity of the returned product and shall not be required to pay any refunds or shipping costs with respect to products that Power Balance determines not to be authentic and/or not purchased from an authorized retailer.
7. All requests for refunds must include the name of the creditor seeking the refund and a legible return address. Refunds will be made via check. Please allow three to five weeks for processing and receipt of your refund.
